Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Sales Journal Pro (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Sales Journal Pro. Your use of the App is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or business purposes.

You May:

• Use the App on devices you own or control
• Track your business sales and inventory
• Export your data

You May NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Distribute, sell, lease, or sublicense the App
• Remove or alter any proprietary notices or labels
• Use the App for any illegal or unauthorized purpose

3. User Accounts

To use certain features of the App, you must create an account using Apple Sign-In or Google Sign-In.

Your Responsibilities:

• Provide accurate and complete information
• Maintain the security of your account
• Keep your contact information up to date
• Notify us immediately of any unauthorized access
• You are responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Your Data

You Own Your Data: You retain all rights to your business data including products, customers, sales records, and other information you enter into the App.

Data Storage: Your data is stored locally on your device. We do not store your business data on our servers.

Backups: You are responsible for maintaining backups of your data. We are not liable for any data loss.

Data Deletion: When you delete your account, your data will be permanently deleted within 30 days.

5. Acceptable Use

You agree to use the App in a lawful and respectful manner. You agree NOT to:

• Use the App for any illegal purposes
• Violate any local, state, national, or international law
• Infringe on intellectual property rights
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's operation
• Use the App to spam or harass others
• Impersonate any person or entity

6. Limitations of Liability

AS IS Basis: The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

We Disclaim All Warranties Including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Accuracy or completeness of data

Limitation of Liability:

To the maximum extent permitted by law, we shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or data
• Business interruption
• Damages exceeding the amount you paid us in the past 12 months

7. Subscription Terms

Pricing:

• Monthly Plan: $9.99 per month
• Annual Plan: $99.99 per year (17% savings)
• Lifetime: $499.99 (one-time purchase)

Billing:

• Subscriptions are billed through Apple's App Store
• Payment is charged to your Apple ID account
• Subscriptions automatically renew unless cancelled 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours before the end of the current period

Cancellation:

• You can cancel your subscription anytime through your Apple ID settings
• Cancellation takes effect at the end of the current billing period
• You will retain access until the end of the paid period

Refunds:

• We do not provide refunds for partial subscription periods
• Lifetime purchases are non-refundable
• For refund requests, contact Apple Support directly

Free Trial:

• New users may receive a free trial period
• You will be charged when the trial ends unless you cancel
• Only one free trial per user

8. Intellectual Property

All rights, title, and interest in and to the App, including all copyrights, trademarks, trade secrets, and other intellectual property rights, are owned by Sales Journal Pro.

The Sales Journal Pro name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Sales Journal Pro. You may not use such marks without our prior written permission.

9. Changes to Terms

We may update these Terms from time to time. When we do:

• We will update the "Last Updated" date
• We will notify you of material changes through the App or via email
• Your continued use of the App after changes constitutes acceptance
• If you don't agree to the new Terms, you must stop using the App

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Request by law enforcement or government agency
• Extended inactivity

You may terminate your account at any time by deleting it through the App settings.

Upon termination, your right to use the App ceases immediately.

11. Indemnification

You agree to indemnify and hold harmless Sales Journal Pro and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction.

13. Dispute Resolution

If you have any dispute with us, please contact us first at contact@gifttracker.cc and we will attempt to resolve it informally.

If we cannot resolve the dispute informally, you agree that any dispute will be resolved through binding arbitration or small claims court, and you waive any right to a jury trial or to participate in a class action.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sales Journal Pro regarding the use of the App and supersede all prior agreements.
